September 2021 Visa Bulletin Updates

According to the Department of State Visa Bulletin, the employment-based Final Action cutoff dates and Dates for Filing have advanced in September 2021, except EB-3 China and EB-5 Regional Center program. The USCIS has announced that it will honor the “Final Action Dates” for all the employment-based Adjustment of Status applications, which means the USCIS will keep the “Dates for Filing” closed in September 2021. The EB-2 Final Action dates have some decent advances for China and India, and EB-3 Final Action dates have advanced fast for India. September is the last month of this fiscal year, and we can usually expect faster movements in October. The details of September 2021 Final Action dates are as below:

  • Final Action Dates of EB-1: China and India remain unchanged on “current”.

  • Final Action Dates of EB-2: China has moved forward from 04/01/2018 to 07/01/2018 (3 months); India has moved forward from 06/01/2011 to 09/01/2011 (3 months).

  • Final Action Dates of EB-3: China remains unchanged on 01/08/2019; India has moved forward from 07/01/2013 to 01/01/2014 (6 months).

  • Final Action Dates of EB-5: For the Non-Regional Center program, China has moved forward from 11/15/2015 to 11/22/2015 (7 days); all other countries remain current. The final action dates for the Regional Center program are still "unauthorized" because the program is set to expire on 06/30/2021 unless reauthorized by Congress. It is possible that the program will be re-authorized before the end of this fiscal year.
