According to the Department of State Visa Bulletin, the employment-based Final Action dates and Dates for Filing have changed significantly in November 2021. The USCIS has announced that it will honor the “Dates for Filing” for all the employment-based Adjustment of Status applications. Notably, the EB-2, and EB-3 Dates for Filing for countries except China and India are still current, and EB-1 is current for all the countries. The details of November 2021 Cut-off Dates are as below:
Cut-off Dates of EB-1: China and India remain unchanged on “current”.
Cut-off Dates of EB-2: China For Filing Date has moved forward from 09/01/2018 to 02/01/2019 (5 months); India For Filing Date has moved forward from 07/08/2012 to 01/13/2013 (6 months). EB-2 Final Action Date for China has moved forward for 4.5 months, and that for India has moved forward for 3 months. If you are in the U.S. waiting to submit EB-2 Adjustment of Status applications, please refer to the “For Filing” dates.
Cut-off Dates of EB-3: China For Filing Date has retrogressed from 01/15/2019 to 04/01/2018 (-9.5 months); India For Filing Date has retrogressed from 01/08/2014 to 01/22/2012 (-24 months). EB-3 Final Action Date for China has retrogressed for 9.5 months, and that for India has retrogressed for 24 months. Cut-off Dates of EB-5: Non-Regional Center program For Filing Date for China remains on 12/15/2015 while all other countries remain current. The final action dates for the Regional Center program are still "unauthorized" because the program is set to expire on 06/30/2021 unless reauthorized by Congress.
