August 2021 Visa Bulletin Updates

According to the Department of State Visa Bulletin, the employment-based Final Action cutoff dates and Dates for Filing have advanced moderately in August 2021, as the end of this fiscal year is approaching. The USCIS has announced that it will honor the “Final Action Dates” again for all the employment-based Adjustment of Status applications, which means the USCIS will keep the “Dates for Filing” closed in August 2021. EB-2 and EB-3 Final Action dates for China and India have advanced moderately this month. The details of August 2021 Final Action dates are as below:

  • Final Action Dates of EB-1: Dates for all countries, including China and India, remain current.

  • Final Action Dates of EB-2: China has moved forward from 12/01/2017 to 04/01/2018 (4 months); India remains unchanged on 06/01/2011; all other countries remain current.

  • Final Action Dates of EB-3: China has moved forward from 01/01/2019 to 01/08/2019 (7 days); India has moved forward from 01/01/2013 to 07/01/2013 (6 months); all other countries remain current.

  • Final Action Dates of EB-5: For the Non-Regional Center program, China has moved forward from 11/08/2015 to 11/15/2015 (7 days); all other countries remain current. The final action dates for the Regional Center program are still "unauthorized" because the program is set to expire on 06/30/2021 unless reauthorized by Congress.
