Our Success Story: L-1A for a Functional Manager

While many believe an L-1A visa requires managing a large team, the "Functional Manager" category allows senior leaders to qualify by overseeing a critical business function rather than a high headcount. This specialized category is designed for senior leaders who oversee a core, essential function of the business, often Finance, Legal, R&D, or Market Strategy, rather than a direct staff of professional employees.

 

The Profile

Our client is a prominent manufacturing enterprise that established a U.S. presence to focus on R&D, strategic coordination, and regulatory oversight. Unlike a traditional factory model, this U.S. entity operated as a "Coordination Platform," outsourcing its physical manufacturing and delivery to third-party American vendors while maintaining a lean, high-level internal team.

 

The Challenge

U.S. branch maintained a very lean internal headcount, as the company utilized a modern, decentralized business model. The entire production team was outsourced to third-party vendors, meaning the manager did not have a traditional hierarchy of direct "W-2" employees to supervise. The primary challenge was to overcome the government’s assumption that without a direct internal team, the manager was merely performing "non-managerial" tasks rather than exercising true managerial authority over a business function.

 

The Strategy

Our strategy focused on proving the manager’s discretionary authority, seniority in the global hierarchy, and essential function and pivoted the narrative to the "Functional Manager" framework, focusing on the manager's total control over the manufacturing function. We documented the manager’s authority to select external vendors, negotiate contracts, and oversee the entire production and quality assurance lifecycle. We demonstrated that all supply chain strategies and output plans required his final approval, proving he held "Core Management Control" over the production flow.

 

The Outcome

Despite the small internal team, the L-1A petition was successfully approved. This allowed the client to successfully launch their U.S. R&D center and maintains their strategic oversight over U.S. manufacturing partners.
